Terms of Service

PLEASE READ THIS END-USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING GLIMT ("APP"). BY USING THE APP, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE APP AND PROMPTLY DELETE IT FROM YOUR DEVICE.

License Grant

Subject to the terms and conditions of this Agreement, TANGEN APPS grants you a limited, non-exclusive, non-transferable license to use the App on a designated number of Apple devices for personal or commercial use.

Purchase and Activation

Direct Purchase -- License Key:
If you purchase the App directly from TANGEN APPS or an authorized reseller, you must obtain a valid license key. The license key is unique to you and must not be shared, distributed, or resold.

Apple Notarization Notice:
The App is distributed outside of the Mac App Store but is notarized by Apple. Notarization means the App has been scanned by Apple for malicious content and meets Apple's security requirements. However, your use of the App is governed solely by this Agreement and not by Apple's App Store Terms of Service.

EU/EEA Consumer Notice -- Right of Withdrawal:
If you are a consumer in the European Economic Area or Norway, you have a statutory right to withdraw from your purchase within 14 days without giving any reason. However, by purchasing, downloading, and using the App immediately, you expressly consent to the immediate delivery of digital content and acknowledge that you thereby lose your right of withdrawal once the download or use has begun.

Acceptance:
By purchasing a license key and using the App, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement.

Ownership

The Licensor retains all right, title, and interest in and to the App, including all intellectual property rights. This Agreement does not convey to you any ownership rights or interest in the App, except for the limited license granted herein.

Updates

Direct Purchase:
During the one-year period following your purchase of the license key, you are entitled to receive free updates to the App. TANGEN APPS reserves the right to charge for major upgrades or additional features released after this period.

Updates may be delivered through in-app mechanisms or via official distribution channels. Where required by applicable law, updates necessary to keep the App in conformity with the Agreement will be provided.

Use Restrictions

Device Use: The license key and the App may only be used on the designated number of devices at a time. You may transfer the App to another device, provided that it is removed from the original device.

Prohibited Actions: You shall not:

  • Reverse engineer, decompile, or disassemble the App, except to the extent expressly permitted by applicable law.
  • Modify, adapt, or create derivative works of the App.
  • Remove, alter, or obscure any copyright, trademark, or proprietary notices.
  • Use the App in any manner that violates applicable laws or regulations.
  • Share, distribute, resell, sublicense, or transfer the license key or the App to any third party.

Data Protection and Privacy

We collect limited personal data necessary to provide licensing and functionality of the App. This includes:

  • Your email address
  • An encrypted machine identifier used for licensing purposes

This data is stored securely using Supabase as our backend service provider.

We do not store or collect credit card information, names, or billing addresses in our own systems. Payments are processed by third-party providers. While we do not collect personal information directly, we ensure that our third-party processors, Stripe and Supabase, employ adequate security measures to protect user information.

We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). You have the right to:

  • Access your personal data
  • Request correction of inaccurate data
  • Request deletion of your data
  • Restrict or object to processing
  • Request data portability
  • Lodge a complaint with your local data protection authority (for Norway: Datatilsynet)

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY APPLICABLE LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANGEN APPS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in this Agreement shall affect your statutory rights as a consumer under applicable law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TANGEN APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE APP.

Nothing in this Agreement shall exclude or limit liability for damages that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury.

Dispute Resolution

If you have any concerns, complaints, or disputes regarding the App or this Agreement, we encourage you to contact us first at hello@glimtapp.io so we can attempt to resolve the matter informally and in good faith.

We aim to respond to all inquiries within a reasonable time and to resolve disputes amicably wherever possible.

Nothing in this section shall limit or restrict your rights to pursue legal remedies, including your right to bring a claim before a competent court or to contact a consumer protection authority.

Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term or condition of this Agreement. Upon termination, you shall cease all use of the App and destroy all copies of the App in your possession or control.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which TANGEN APPS is established.

If you are a consumer in the European Economic Area or Norway, you may also have rights under the mandatory laws of your country of residence.

Entire Agreement

This Agreement constitutes the entire agreement between you and TANGEN APPS with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.
